General Terms and Conditions
Effective Date: 27.11.2025
These General Terms and Conditions (the "GTC") of Harvia Austria GmbH apply to all contracts for the delivery of products concluded through our online store. These GTC form an agreement between you (hereinafter “you” or "Customer") and Harvia Austria GmbH. References to "Harvia", "we", "our" or "us" throughout these GTC refer to Harvia Austria GmbH. The inclusion of the Customer's own terms is hereby excluded.
Our online store is available exclusively to consumer customers (not businesses) located within the European Union and the European Economic Area.
We explain how we process your personal data in Harvia’s privacy notice (“Privacy Notice”).
1. General provisions
1.1 Acceptance of the GTC: You must accept these GTC in order to make a purchase and to place an order through the online store. By accepting these GTC, you agree to comply with these GTC, and you represent that you are age 18 or older and otherwise recognised as being able to form legally binding contracts under applicable law. If you do not meet these requirements, you may not make a purchase or place an order through the online store.
1.2 Business Customers: If you are placing an order on behalf of a legal entity, these GTC shall apply to such order unless otherwise agreed in writing between you and us. However, section 6 (Withdrawal and Returns) shall not apply to orders placed by legal entities, as such provisions are available to consumers only. If you act on behalf of a legal entity, you represent and warrant that you have the authority to bind that entity to these GTC, and "you" or "Customer" will then refer to the entity you represent.
1.3 Applicable Terms and Changes: Orders are subject to the version of the GTC in force at the time the order is placed, available at shop.harvia.com.
1.4: Installation Responsibilities and Requirements: Harvia is not responsible for any installation, plumbing, ventilation, electrical, or other technical work (HVAC work) required to install products ordered through the online store. All such work remains the Customer's sole responsibility.
Pre-Installation Verification Obligations:
Customers must verify, prior to ordering or installing any product, whether:
a) The intended installation location permits sauna installation under applicable zoning regulations, development plans, or local building codes;
b) Any building permits, planning permissions, or regulatory approvals are required for the product installation at the specific location;
c) The proposed installation complies with all applicable boundary distance requirements, fire safety regulations, and neighbourhood protection laws; and
d) Any additional permits are required for specific components (such as wood-burning stoves, electrical connections, water supply, or foundations).
Note: In certain jurisdictions (including Germany), sauna installations may be subject to location-specific restrictions, size limitations, and permit requirements that vary by region, municipality, and property type. Customers are solely responsible for determining and complying with all such requirements by consulting with their local building authority or relevant regulatory body.
Installation Requirements:
Customers must ensure that all installation work is carried out in accordance with:
a) Applicable building codes and construction regulations;
b) Electrical safety regulations and standards;
c) Harvia’s installation instructions; and
d) All relevant local, regional, and national legal requirements.
For electrical installations and connections, customers must use qualified and appropriately licensed professionals. For other installation work, such as sauna assembly and wood-burning heater installation, customers may carry out the work themselves (provided they follow other installation requirements, as applicable).
The customer must comply with all provided installation, usage, and safety instructions.
1.5: Opening an Account in the Online Store: Registration is not required to place an order through our online store. Where account registration functionality is available, you may register for an account by completing the registration form on our website. Opening an account with our online store is free of charge.
2. Order Process
The display of products in the online store constitutes an invitation for you to place an order with us. It does not constitute a binding offer by Harvia to enter into a purchase contract.
You may add products to your shopping cart and proceed to checkout. By completing the checkout process and submitting your order by clicking the button with the wording ‘pay and place order’ or a correspondingly formulated wording, you make a binding purchase offer for the products in your shopping cart. When you submit your order and authorise payment, your payment is processed immediately by our payment service provider (such as Stripe).
After receipt of the purchase offer, you will receive an automated email confirming that we have received your order and that payment has been received. This acknowledgement of receipt does not constitute acceptance of your purchase offer, and no purchase contract is formed at this stage.
A binding purchase contract between you and Harvia is concluded only when we send you a delivery confirmation confirming that your order has been prepared for dispatch.
The product’s price is the price indicated in the online store at the time of order (including VAT). Delivery costs determined by the chosen delivery method will be added to the product’s price at checkout. You may be required to pay duty, VAT, or customs charges on your purchase.
3. Delivery, Shipping and Availability
3.1 Delivery Methods: Before you place your order, you will be clearly informed of all delivery costs and the total price of your purchase, including all taxes and charges. You must give your explicit consent to any additional delivery costs.
Delivery is made to the delivery address specified by you during the order process. The delivery address provided in the checkout process is decisive for all delivery arrangements. You must ensure that you have provided a correct and complete delivery address at the time of your order. Any additional costs arising from culpable incorrect address information – such as re-delivery or return shipping costs – will be borne by you, provided that Harvia has taken reasonable steps to verify the delivery address with you before dispatch.
Harvia reserves the right to change the method of delivery after the order confirmation. Any such changes will not result in additional costs to you.
3.2 Delivery Times and Dispatch: Orders are typically delivered within 1-2 weeks from the order confirmation. As clarified, you will receive a delivery confirmation when your order has been prepared for dispatched (and at which point a binding purchase contract is concluded). During peak seasons and public holidays, dispatching and delivery may take slightly longer than usual. Please note that delivery times are estimates only and do not constitute a strict deadline.
We will seek to ensure that the carrier will contact you a well before delivery to schedule a delivery time, ensuring you are available and prepared for the delivery. Your products will never randomly appear at your doorstep; you will always be informed and integrated into the delivery timeline.
Once you have approved the delivery time proposed by the shipping company, you must ensure that someone is available to receive the delivery. You may incur necessary storage costs of up to €100 per day if you have not provided a valid reason and are not available to receive your delivery within 48 hours of being contacted by the freight company to arrange the delivery appointment.
If you order multiple products with different delivery times, the delivery time for your entire order will be the longest delivery time specified for any product in your order, unless we agree to split delivery (which may incur additional delivery charges).
3.3 Delivery Options and Costs: Standard delivery to Germany and Austria costs €300. Currently we offer free shipping for orders over €150 to Germany and Austria.
For deliveries to German islands (including Rügen, Usedom, Fehmarn, Sylt, Föhr, Pellworm, Poel, Borkum, Norderney, Amrum, Langeoog, and others), additional delivery costs of €300 apply.
3.4 Access Requirements and Delivery Location: You are responsible for ensuring that the delivery location is accessible for standard freight delivery vehicles.
Sufficient access means the delivery vehicle must be able to access the delivery point without difficulty and must have enough space to manoeuvre and leave without any problem. You may incur additional delivery charges if the roads to your delivery location have restrictions that prevent access by standard freight delivery vehicles. This includes, but is not limited to, remote locations and island locations.
In the event that the delivery conditions are not adequate (such as remote locations with restricted vehicle access or difficult access areas including mountain regions or narrow roads), Harvia may contact you to discuss alternative delivery arrangements or, reject the Customer’s order, cancel, terminate or dissolve the purchase contract and refund the products price to you.
3.5 Curbside Delivery: For products delivered by freight forwarding, delivery shall be made free curbside, i.e. to the public curbside nearest to the delivery address. The standard delivery protocol is to leave the products at a curbside location, which might be near your driveway or garage. Pallets or packages may in some cases be delivered to the front door of your home. No products will be mounted or placed inside your home.
You are therefore responsible for moving the products from the curb to a safe and dry storage location. We recommend that 2 people be present on the day of delivery. For your safety, wear protective gloves and glasses before handling the products.
3.6 Product Availability and Pricing Errors: Harvia shall not be liable to you and is not obliged to fulfil its delivery obligation if a particular product is no longer available due to circumstances beyond our reasonable control or if errors appear in the online store (for example, in product descriptions), pricing information or stock availability information. Harvia has the right to correct such errors and to change or update information provided in the online store at any time. Harvia will reject an order in any case if the price stated in the online store differs significantly from the actual market price due to, for example, a technical error in the online store or human error. In such cases, we will notify you promptly and offer you the option to proceed with the order at the correct price or receive a full refund. However, Harvia will not charge a higher price than the price stated at the time of order without your explicit consent.
4. Inspection Upon Delivery
The terms and conditions governing Harvia's limited voluntary commercial warranty, including any inspection and notification requirements (as amended from time to time), are set forth in Section 7.5 below.
However, in order to process (statutory) warranty claims as quickly as possible, we recommend that you examine the delivery carefully upon arrival, check the packaging and its integrity in the presence of the courier and that you:
a) Check the delivery receipt/shipping document to ensure the number of items shipped matches what you are receiving; and
b) Inspect the packaging for any visible damage (e.g. torn film, damaged boxes, crushed packaging).
If you notice any damage to the packaging, to process a (statutory) warranty claim as quickly as possible, we recommend to accept the package and report the damage to the courier, who is obliged to record the complaint, and to note the damage report directly on the delivery receipt/shipping document and to sign it, both you and the courier who delivered the products.
We advise attaching photographs of the damaged package to any such notification, if possible.
If you are unable to verify the integrity of the package at the time of delivery, we recommend taking a video of the unpacking process, showing the unopened package.
Please inform us of any damaged or incomplete products in accordance with Section 9.4, and if possible sending us the unpacking video and photographs (if available) at the same time.
Inspection Before Installation
Prior to installation and assembly, we recommend that the products should be inspected by you or your installer for external damage to ensure that they are free from visible defects or damage. If you discover defects before installation, you should contact us immediately in accordance with section 9.4. For the avoidance of doubt, this does not affect your statutory rights regarding defects.
5. Payment Options
We accept the following payment methods for all purchases made through our online store:

All payments must be processed electronically using one of the accepted payment methods listed above. Payment by cash on delivery is not available.
6. Withdrawal and Returns
Right of Withdrawal Information
6.1 Right of Withdrawal: You have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you, or a third party other than the carrier indicated by you, acquires physical possession of the products. In the case of multiple products ordered in one order and delivered separately, the withdrawal period begins on the day you acquire physical possession of the last good.
To exercise your right of withdrawal, you must inform us (Harvia Austria GmbH, Wartenburger Straße 31, 4840 Vöcklabruck, Austria) of your decision to withdraw from this contract by means of a clear statement.
You may use the attached model withdrawal form, but it is not mandatory.
You can also complete and submit the model withdrawal form or another clear statement electronically on our website under https://support.harvia.com/ (language can be changed at the site). If you make use of this option, we will promptly (e.g., by email) send you a confirmation of receipt of such a withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

6.2 Effects of Withdrawal: If you withdraw from this contract, we are obliged to reimburse you all payments we have received from you, including the costs of delivery (except for any additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we receive the notification of your withdrawal from this contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless we have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the products back or you have supplied evidence of having sent back the products, whichever is the earliest.
6.3 Returning the Product; Costs for Returning the Products: You must send back the products or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this purchase contract to us. The deadline is met if you send back the products before the period of 14 days has expired.
You shall bear the direct cost of returning the goods. The cost is estimated at no more than €500.
You are only responsible for any diminished value of the goods if this loss in value is due to handling the goods in a way that was not necessary to examine their nature, characteristics, and functioning.
6.4 Exclusions from the Right of Withdrawal: The right of withdrawal is excluded in the following cases: (i) If you have ordered goods for delivery which are not prefabricated and which have been produced on the basis of your individual choice or specification, or which were clearly tailored to your personal needs or (ii) if you have ordered sealed goods for delivery which are not suitable for return for reasons of health protection or hygiene, where the seal has been removed after delivery.
7. Defective, Damaged or Incorrect Products, Liability, Warranty
7.1 General: Harvia is responsible for defects under the statutory provisions, as applicable.
If the product you received is defective, e.g., is broken, missing parts, damaged during transport, or you received the wrong product, please do not use the withdrawal procedure described in section 6 above. In case the product received by you is defective or you have been billed for a product you did not receive, please contact us in accordance with section 9.4.
When reporting a defect, please provide the following information to help us process your claim efficiently:
Your order number and date of purchase;
Serial number, if available;
A brief description of the defect;
The circumstances and date when the defect was discovered;
Your contact details;Your preferred remedy (e.g., repair, replacement, or refund); and
Photographs of the defect are also helpful.
7.2. Business customers: If the buyer is a business customer and the transaction constitutes a commercial sale for both parties, the buyer must examine the goods upon delivery and, if a defect becomes apparent, must notify Harvia without undue delay.
7.3 Exclusion of warranty: Harvia excludes all warranty claims for defects arising from or related to:
a) Improper installation or failure to engage qualified professionals;
b) Installation in locations where product installation is prohibited or restricted under applicable regulations;
c) Failure to obtain required permits, approvals, or neighbour consents;
d) Inadequate site preparation or non-compliance with installation instructions; or
e) Non-compliance with applicable building codes, zoning regulations, or other legal requirements.
7.4 Liability
7.4.1 Unlimited Liability: Harvia shall be liable without limitation for:
a) Intent and gross negligence;
b) Breach of a contractually granted guarantee;
c) Claims under the applicable Product Liability Act; and
d) Damage resulting from injury to life, body, or health of persons (including in cases of slight negligence);
7.4.2 Limited Liability: In the event of slight negligence, Harvia shall only be liable for breach of a material contractual obligation, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which you may regularly rely (cardinal obligation). In such cases, liability is limited to foreseeable, typically occurring damage.
7.4.3 Exclusion of Liability: Except as provided under 7.4.1 and 7.4.2, Harvia is not liable for damages caused by slight negligence.
7.5. Voluntary Warranty
Harvia grants a limited voluntary warranty on its new products. The warranty terms are available at https://www.harvia.com/en/warranty/ and form part of these GTC. In the event of any conflict between the warranty terms and these GTC, the warranty terms shall prevail with respect to warranty claims.
8. Promotional Discounts and Special Offers
All promotional discounts and special offers available through our online store are subject to the terms and conditions set out in this section 8, as well as any additional terms specified in the relevant campaign information available at our online store from time to time.
Prior product prices are indicated in connection with each discount and offer in accordance with applicable price indication requirements under German and Austrian law.
All promotional discounts and special offers are valid for a limited time only, as specified in the relevant campaign information. Harvia reserves the right, at any time and at its sole discretion, to modify, suspend, or cancel any promotional discount or special offer before its stated expiry date without prior notice.
Promotional discounts and special offers may be limited to specific products featured in our online store. Eligible products are subject to change at Harvia's sole discretion. Product availability during promotional periods is subject to stock availability as set out in section 3.6 (Product Availability and Pricing Errors).
Harvia reserves the right to refuse or cancel any order where promotional discounts have been used fraudulently, in violation of these GTC, or in a manner inconsistent with the spirit of the promotion.
Promotional discounts may be redeemed only once per customer, and only one promotional discount may be applied per order unless expressly stated otherwise in the campaign terms. Multiple promotional discounts cannot be combined.
Promotional discounts must be applied and redeemed before the order is confirmed. Discounts cannot be applied retroactively to purchases after Harvia has sent the order confirmation.
9. Other terms
9.1 Severability: If any provision of these GTC is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining terms or parts thereof shall remain in full force and effect.
9.2 Waivers: The failure of Harvia to require or enforce strict performance by you of any provision of these GTC or failure to exercise any right under them shall not be construed as a waiver or relinquishment of Harvia’s right to assert or rely upon any such provision or right in that or any other instance. The express waiver by Harvia of any provision, condition, or requirement of these GTC shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.
Except as expressly and specifically set forth in these GTC, no representations, statements, consents, waivers, or other acts or omissions by Harvia shall be deemed a modification of these GTC nor legally binding, unless documented in physical writing, hand signed by you and a duly appointed officer of Harvia.
9.3 Entire Agreement: These GTC and any documents expressly incorporated by reference herein, contain the entire understanding of you and Harvia, and supersede all prior understandings of the parties hereto relating to the subject matter hereof, whether electronic, oral or written, or whether established by custom, practice, policy or precedent, between you and Harvia with respect to the subject matter.
9.4 Notices: All notices or communications under these GTC must be in writing or in text form. We encourage you to contact us through our online support form at https://support.harvia.com/ (language can be changed at the site). Alternatively, you may contact us by email at info@harvia.com or by post to Harvia Austria GmbH, Wartenburger Straße 31, 4840 Vöcklabruck, Austria. We may notify you via email to the address you provided during the order process, via notices posted in the online store, or by post. You are responsible for ensuring that your contact details are current and accurate.
9.5 Subcontractors: Harvia may subcontract the performance of its obligations, in whole or in part. Harvia remains fully responsible for the acts and omissions of its subcontractors as if they were its own.
9.6 Assignment: Harvia may assign or delegate these GTC, in whole or in part, to any person or entity, including Harvia’s affiliates, at any time with or without your consent You may not assign or delegate any rights or obligations under the GTC without Harvia’s prior written consent, and any unauthorised assignment and delegation by you is ineffective.
9.7 Force Majeure: Harvia shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, without limitation, acts of God, war, terrorism, riots, embargoes, orders of authorities for which it is not responsible, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.
10. Applicable law and dispute resolution
10.1 General: For the avoidance of doubt, if the jurisdiction of your domicile prohibits Harvia from enforcing the governing law provision, nothing in these GTC limits your rights based on the laws governing your domicile.
10.2 Customers in Germany: If you are a resident of the Federal Republic of Germany, this section 10.2 shall apply. These GTC are governed by the laws of the Federal Republic of Germany regardless of conflict of law provisions. If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us shall be Munich. If you are a consumer, you may bring legal action against Harvia before the courts of Munich or before the competent court at your place of residence. Legal action by Harvia against you as a consumer may only be brought before the court of your place of residence.
10.3 Customers in Austria: If you are a resident of Austria, this section 10.3 shall apply. These GTC are governed by the laws of Austria regardless of conflict of law provisions. If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us shall be Wels. If you are a consumer, you may bring legal action against Harvia before the courts of Wels or before the competent court at your place of residence. Legal action by Harvia against you as a consumer may only be brought before the court of your place of residence.
10.4 Alternative Dispute Resolution Harvia is not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
